GoTime Digital Terms of Service

Effective Date: March 29, 2025

These Terms of Service ("Terms") govern your use of any product, service, website, application, content, or platform provided by GoTime Digital, LLC (“GoTime”, “we”, “our”, or “us”).

By engaging with our services—including experiential events, digital platforms, gamified training environments, or embedded technologies—you agree to comply with these Terms and all related documents (e.g., Privacy Policy, AUP, Cookie Policy).

1. Scope of Services

GoTime Digital is a multi-layered technology and marketing engine providing:

  • Experiential Technology Marketing (XTM)

  • Managed IT and compliance services

  • Cloud, voice, and security infrastructure

  • Gamified environments (e.g., Cyber Grand Prix™, ForgeOS™, Podium Rankings)

  • AI-enabled sales training and simulations

  • Licensing of white-labeled tools, playbooks, or engagement systems

Your use of any GoTime service is subject to these Terms.

2. Account, Access & Conduct

You agree to:

  • Provide accurate registration and business information

  • Maintain confidentiality of login credentials

  • Notify us immediately of unauthorized access or data breaches

Misuse of platform tools, credential sharing, or impersonation may result in account suspension.

3. Intellectual Property & Licensing

All content, software, gamified frameworks, and event experiences are proprietary to GoTime Digital or its partners. This includes but is not limited to:

  • ForgeOS™

  • Cyber Grand Prix™

  • TechPath+™ Bundles

  • GoTime Elite™ Tracks and Certification Models

  • AI Sales Simulators & Podium Ranking Systems

You are granted a non-exclusive, non-transferable license to access GoTime Digital products or experiences only as intended. You may not:

  • Resell, license, or reproduce GoTime IP

  • Reverse-engineer or extract proprietary systems

  • Simulate or scrape behavioral data for training external AI systems

  • Misrepresent competitive results, gamified rankings, or certification status

Violation will result in immediate access revocation and possible legal action.

4. Third-Party Platforms

GoTime integrates with select partner platforms and carriers (e.g., cloud providers, mobile networks, compliance systems). All such services are provided “as-is.” GoTime is not liable for third-party outages, limitations, or pricing shifts.

5. Payment & Billing

All pricing terms, subscriptions, or project-based fees will be outlined in your service agreement or proposal. Billing cycles begin upon:

  • Activation of services

  • Execution of a Statement of Work (SOW)

  • Confirmation of platform provisioning

Late payments may result in suspension or penalty fees. All sales are final unless stated otherwise.

6. System Access & Delivery

GoTime aims for 99.999% uptime across core environments. We may occasionally conduct maintenance, updates, or system optimizations. Delivery dates for services, platforms, or events are estimates only and may vary based on third-party dependencies.

7. Acceptable Use

You may not use GoTime systems to:

  • Violate local, state, or federal law

  • Distribute malware, unauthorized bots, or denial-of-service attempts

  • Game, manipulate, or falsify gamified results, metrics, or rankings

  • Share, republish, or clone live simulations or Cyber Grand Prix™ modules

  • Engage in deceptive sales tactics within GoTime-run events or tools

All usage is subject to our Acceptable Use Policy (AUP).

8. Consultation Services & Results Disclaimer

GoTime’s services—including strategy, consulting, and gamified playbooks—are provided in good faith. We do not offer legal advice or guarantee outcomes from sales training, gamified events, or strategy sessions. Execution of outcomes is your responsibility.

9. Security, Privacy & Compliance

All data handling aligns with our Privacy Policy, Trust & Security Statement, and CPNI-style Data Rights Notice. You consent to session tracking, AI-based performance analysis, and engagement monitoring for training, auditing, and security purposes.

You may opt out of marketing communications but cannot opt out of operational or legal notices.

10. Disclaimers & Liability Limitations

All GoTime services are provided “as-is” without warranties, express or implied. GoTime is not liable for:

  • Lost profits

  • Data breaches caused by customer error or third parties

  • Performance failures from acts of God, ISP outages, or hardware disruptions

  • Delayed delivery of gamified content or simulation platforms

Total liability is capped at the amount paid by you in the 30 days preceding any claim.

11. Indemnification

You agree to indemnify and hold harmless GoTime Digital, its affiliates, team members, and partners from any claim or liability arising from:

  • Your misuse of GoTime systems

  • Your breach of these Terms

  • Any action you take based on guidance or use of our technology

12. Termination

GoTime may terminate access at any time for cause, including:

  • Fraud

  • Security risk

  • Intellectual property theft

  • Repeated policy violations

Upon termination, all rights to access GoTime systems or platforms immediately cease.

13. Force Majeure

GoTime is not responsible for delays, interruptions, or failures due to events beyond our control, including acts of God, government restrictions, cyberattacks, pandemics, or utility failures.

14. Governing Law

These Terms are governed by the laws of the State of Georgia. Any legal dispute must be filed exclusively in the courts of Fulton County, GA.

15. Entire Agreement

These Terms, together with the Privacy Policy, AUP, Data Notice, and any signed service agreement, represent the full agreement between you and GoTime Digital.
